Overview
The Department of Health is responsible for the Tobacco and Electronic Cigarette Sales Act. The Department of Justice and Public Safety is responsible for licensing and inspections under the Act. Licenses are valid until March 31st of each year.
Eligibility
A licence may be issued to a person who wishes to operate a vapour shop and has completed an application for a licence, paid the required fee and has demonstrated compliance with the Tobacco and Electronic Cigarette Sales Act and its regulation. Applicants must be at least 19 years of age.
Description
Retailers that primarily sell vapour products require a vapour shop licence. The only exceptions where a vapour shop licence is not required is:
1. if the operation sells tobacco (If the operation sells tobacco an Application for a Retailer’s Licence is required pursuant to the Tobacco Tax Act); or
Applicants must:
1.be at least 19 years of age,
2.abide fully by the standards and requirements for responsible retail sales established in accordance
with the Tobacco and Electronic Cigarette Sales Act and New Brunswick Regulation 94-57,
3. have sufficient training, knowledge and experience to operate the vapour shop in accordance with the Act and the regulation, and
4. ensure that the employees have or will have sufficient training, knowledge and experience to operate the vapour shop in accordance with the Act and the regulation.
Individuals operating a vapour shop that requires a licence are subject to charges under the Tobacco and Electronic Cigarette Sales Act if they are found to be operating without a licence. Licensed vapour shops are subject to inspection by the Department of Justice and Public Safety. Operators do not know when the inspections will be conducted. Violations of the Act or regulation generally result in additional follow-up compliance inspections but may also result in licence revocation.
