Overview

The Employment Standards Branch is a neutral body that investigates any complaint filed by any person under the Employment Standards Act. The investigation seeks to determine if there has been a violation of a provision of the Employment Standards Act and its Regulations.

Eligibility

Any person may file a complaint under the Employment Standards Act.

Description

The filing of a complaint is usually first screened by the Employment Standards officers who work on a toll-free help line (1-888-452-2687). Any person who wishes to file a complaint will have their complaint assigned to an Employment Standards officer in one of the 5 regional offices around the province. The Officer contacts both the employer and employee to determine the relevant facts to assist the officer in making a determination. It is also possible for persons to file confidential complaints.

If the investigating officer is unable to resolve the matter, it may end up before the New Brunswick Labour & Employment Board who will render a final and binding decision on the matter.
